Welcome to Ever + Hence.

These Terms & Conditions apply when you use everandhence.com or purchase products from Ever + Hence. The Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy also form part of these Terms.

By placing an order, you agree to the terms that apply to that purchase.

Products

Ever + Hence creates and sells small-run physical and digital creative products, including monthly editions, correspondence, original or handmade work, paper goods, ephemera, printables and related items.

Many products are handmade, assembled by hand or created using analogue processes.

Small differences in colour, placement, texture, cutting, printing, handwriting or handmade elements are normal and are part of the nature of the product. They are not necessarily defects.

Product photographs are intended to represent products accurately, but screens, photography and handmade variation may cause differences in appearance.

Limited editions and availability

Some Ever + Hence products are produced in limited quantities.

An item being shown on the website does not guarantee that it will remain available. Products may sell out and may not be reproduced.

Archive editions may consist of remaining unsent pieces from an original production run rather than newly reproduced copies. The individual product description will explain where this applies.

Presales

Some monthly editions may be offered before production is complete.

A successful presale reserves your place in that production run. Production and mailing timing will be stated or estimated on the relevant product page or in order communications.

Because these products are often made or assembled specifically for a limited monthly run, production may begin before the sales period closes.

Prices and currency

Unless clearly stated otherwise, prices on everandhence.com are shown and charged in Canadian dollars (CAD).

Applicable shipping charges, taxes or other costs will be shown or described before purchase where required.

Some products include shipping in their displayed price.

If customs duties, import taxes, brokerage fees or similar charges apply at the destination and are not collected by Ever + Hence, they are generally the responsibility of the recipient unless the product listing states otherwise.

Destination restrictions

Not every product is available in every country.

Certain editions may be Canada-only, correspondence-only in particular countries, digital-only in particular locations or otherwise restricted because of postal, customs or regulatory requirements.

Any product-specific restriction shown on the product page forms part of the conditions of purchase.

Orders placed contrary to a clearly stated destination restriction may be cancelled and refunded.

Payment

Payment is due when the order is placed unless the product page states otherwise.

Payments are processed using the payment methods offered at checkout.

An order is not considered accepted merely because information has been submitted. Ever + Hence may cancel and refund an order where there has been an obvious pricing or technical error, suspected fraud, inventory error, shipping restriction or other legitimate reason the order cannot reasonably be fulfilled.

Digital products

Digital purchases are licensed rather than sold outright as intellectual property.

Unless a product specifically provides different licence terms, Ever + Hence digital files are for the purchaser’s personal use.

You may print and use the files in your own personal projects. Where a product licence expressly permits it, you may also sell finished physical items that you personally make using the files.

You may not resell, redistribute, upload, share, reproduce for distribution or otherwise provide the original digital files—or individual extracted components from those files—to another person.

Purchasing a digital product does not transfer copyright or ownership of the underlying artwork or design.

Website content and copyright

Unless otherwise stated, the artwork, writing, photographs, designs, downloads, branding and other original content published by Ever + Hence remain the intellectual property of their respective owner.

You are welcome to link to Ever + Hence and share ordinary links to publicly available pages.

Website content may not be copied, republished, sold or presented as someone else’s work without permission.

Website availability and errors

I try to keep product information, availability and pricing accurate.

Occasionally there may be a typo, outdated piece of information, inventory error or technical problem. Ever + Hence may correct genuine errors and, where necessary, contact affected customers or cancel and refund an affected order.

Website access cannot be guaranteed to be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by applicable law, Ever + Hence will not be liable for indirect, incidental, special or consequential losses arising from use of this website or the purchase or use of a product.

Where liability may legally be limited, Ever + Hence’s total liability relating directly to a particular order or product will not exceed the amount paid for that order or product.

Nothing in these Terms excludes, restricts or overrides any consumer right, statutory warranty, remedy or liability that cannot legally be excluded or limited.

Things outside reasonable control

Ever + Hence is not responsible for delays or failure caused by events reasonably outside its control, including postal disruptions, severe weather, natural disasters, transportation interruption, customs delays, labour disruption, widespread technical outages or government restrictions.

Where one of these events materially affects an order, I will make reasonable efforts to communicate with affected customers and find a sensible solution.

Governing law

These Terms are governed by the applicable laws of Nova Scotia and Canada, without limiting any mandatory consumer protection rights that may apply to you under applicable law.

If part of these Terms cannot be enforced

If one provision of these Terms is found to be unlawful or unenforceable, that provision may be limited or removed to the minimum extent necessary without invalidating the rest of the Terms.

Changes

These Terms may be updated occasionally.

The version that applied when your order was placed will continue to govern that order to the extent required by law.
